General Terms and Conditions of Bastelgarage 

1. Scope 

For the use of this website and the business relationships between Bastelgarage and its customers, the following General Terms and Conditions (GTC) apply in the version available and valid at the time of accessing the website or ordering goods. The offer on this website is exclusively directed at customers residing in Switzerland.

A customer is defined as any natural or legal person who maintains business relations with Bastelgarage. The GTC, delivery and payment conditions, as well as privacy policies may be adjusted from time to time. Bastelgarage requests that these provisions be carefully read through with each visit to the website and each goods order. 

These GTC exclusively apply. Contradictory, supplementary, or conditions deviating from these GTC require express written confirmation by Bastelgarage for their validity. By using this website or placing an order for goods, the customer fully acknowledges these GTC including delivery and payment conditions. Should any provisions of these GTC prove to be invalid or unenforceable, or become invalid or unenforceable, the validity of the remaining provisions shall not be affected.

2. Information on this website

Bastelgarage contains information on products and services. Price and assortment changes as well as technical changes are reserved. All information on www.bastelgarage.ch (product descriptions, images, films, dimensions, weights, technical specifications, accessory relationships and other information) are to be understood as approximate values only and particularly do not constitute a guarantee of properties or warranties, unless explicitly stated otherwise. Bastelgarage endeavors to provide all information and data on this website correctly, completely, up-to-date, and clearly but cannot guarantee this either expressly or implicitly.

All offers on this website are non-binding and not to be understood as a binding offer. Bastelgarage cannot guarantee that the listed products will be available at the time of ordering. Therefore, all information on availability and delivery times is without guarantee and may change at any time and without notice.


3. Prices

We are subject to VAT from 01.01.2019. Our VAT number: CHE-373.099.786 Prices are understood to be gross in Swiss Francs (CHF). Any shipping costs will be charged additionally, where not otherwise provided, and must be paid by the customer. Shipping costs are separately stated during the ordering process.

Technical changes, errors, and printing errors are reserved, in particular, Bastelgarage can make price changes at any time and without prior notice. The sales prices do not include advisory and support services.


4. Conclusion of Contract

The offers on this website constitute a non-binding invitation to the customer to order products and/or services from Bastelgarage. By placing an order on this website including the acceptance of these GTC, the customer submits a legally binding offer to conclude a contract. Bastelgarage will then send an automatic "order confirmation" by email, which confirms that the customer's offer has been received by Bastelgarage. Placed orders are binding for the customer. Unless otherwise noted, there is no right of return or withdrawal.

The contract is concluded as soon as Bastelgarage sends an acceptance declaration by email, confirming the shipment of the ordered products or services.

Orders will only be shipped after full payment has been received and if the goods are available. If after the conclusion of the contract it appears that the ordered goods cannot be delivered or cannot be fully delivered, Bastelgarage is entitled to withdraw from the entire contract or a part of the contract. If the customer's payment has already been received by Bastelgarage, the payment will be refunded to the customer. If no payment has been made yet, the customer is released from the obligation to pay. Bastelgarage is not obliged to make a replacement delivery in the event of contract dissolution.


5. Payment options and Reservation of Title

The customer has the following payment options: Purchase on account (prepayment) and PayPal.

Special conditions apply for payment by invoice:

  • The invoice is payable within 7 days
  • Should the customer fall into arrears with payments, we reserve the right to charge the customer default interest at the rate of 15% p.a.
  • The first payment reminder is free of charge
  • The second reminder costs 15 CHF
  • For the last reminder, we also charge a flat rate of CHF 30.00. In this case, you commit to paying the invoices plus default interest and reminder fees
  • If the outstanding claim is still not settled, we will initiate legal proceedings (collection, lawsuit) without further notice; the customer pays the costs
  • Furthermore, we are entitled to refuse all deliveries from other contractual relationships. We are not liable for any damages from this non-delivery

Delivered goods remain the property of Bastelgarage until full payment is made. Prices, technical changes, and errors are subject to change. Legal recourse is excluded.


6. Delivery, Inspection Obligation, Notice of Defects, and Return

Items available from stock are usually delivered within 24 hours. Under no circumstances do delivery delays justify claims for damages or a right of withdrawal from the contract. Deliveries, i.e., shipping, are at the cost and risk of the customer. Shipping costs are indicated to the customer before the order is sent. For a goods value of CHF 80.00, delivery within Switzerland and Liechtenstein is free of shipping costs.

Deliveries are sent by post or courier service to the address given by the customer in the order. With the dispatch, benefits, and risk transfer to the customer, to the extent legally permissible. The customer is obliged to inspect the delivered goods immediately upon receipt of the delivery and to report any defects for which Bastelgarage provides a warranty immediately in writing via Return Form . Returns to Bastelgarage are at the expense and risk of the customer. The customer must send the goods back in their original packaging, complete with all accessories, and together with the delivery note to the return address specified by Bastelgarage in the (Imprint). If Bastelgarage's inspection reveals that the goods do not have identifiable defects or these are not covered by the manufacturer's warranty, Bastelgarage may charge the customer for the trouble, the return, or the possible disposal.


7. 10 Day Return Policy

The customer is granted a right of withdrawal for 10 calendar days after receipt of the goods. The deadline is deemed to have been met if the customer sends the written withdrawal via Return Form within the period to Bastelgarage. The withdrawal does not require any justification. Please note that only prepaid packages will be accepted. Excluded from the return policy are: batteries, rechargeable batteries, semiconductors, or similar items, lamps, assembled kits and parts that have already been installed, special orders, metered goods, consumables. Note also that the shipping costs for returns are always borne by the sender. Unstamped packages and shipments will not be accepted.

The exercise of the right of withdrawal leads to a reversal of the contract. The customer must return the goods within 10 calendar days in their original packaging, complete with all accessories, and together with the delivery slip to the return address specified by Bastelgarage in the Imprint . Returns to Bastelgarage are at the expense and risk of the customer. Any payment already made will be refunded to the customer within 20 calendar days, provided Bastelgarage has already received the goods back.

Bastelgarage reserves the right to demand reasonable compensation for damages, excessive wear, or value reduction due to improper handling and to deduct the depreciation from the already paid purchase price or to invoice the customer.

In the following cases, no right of withdrawal is granted:

  1. If the contract involves a movable item that is manufactured according to the specifications of the consumer or is clearly tailored to the personal needs of the consumer;
  2. If the contract involves digital content and these contents are not provided on a tangible medium or if the contract is to be fully fulfilled by both contract parties immediately;
  3. If the contract involves a service and the contract is to be fully performed by the provider with the prior express consent of the consumer before the withdrawal period has expired.


8. Warranty

Bastelgarage strives to deliver goods in faultless quality. In case of timely notified defects, Bastelgarage provides a warranty for the absence of defects and functionality of the purchased item during the legal warranty period of generally 24 months from the date of delivery. It is at Bastelgarage's discretion to fulfill the warranty by free repair, equivalent replacement, or by refunding the purchase price. Further claims are excluded.

The warranty does not cover normal wear and tear, and the consequences of improper handling or damage by the customer or third parties, as well as defects that are due to external circumstances, are not included. The warranty is also excluded for kits, modules, components, kits, and batteries. Bastelgarage cannot assure or guarantee the timeliness, completeness, and accuracy of the data, as well as the continuous or uninterrupted availability of the website, its functionalities, integrated hyperlinks, and other content. In particular, there is no assurance or guarantee that the use of the website does not violate rights of third parties that are not owned by Bastelgarage.


9. Liability

Bastelgarage excludes any liability, regardless of its legal basis, as well as claims for damages against Bastelgarage and any auxiliary persons and agents. Bastelgarage is not liable for indirect damages and consequential damage, loss of profit, or other personal, material, and pure financial losses of the customer. Reserved is a further mandatory statutory liability, for example, for gross negligence or unlawful intent. All offered electrical and electronic products are exclusively intended as aids for professionals for development and experimental purposes under laboratory conditions, without independent function and are not intended for end users. Professional knowledge is required to assemble, use, and/or operate them. The customer assumes full responsibility for compliant and safe application. We decline any liability.

Bastelgarage uses hyperlinks solely for the simplified access of the customer to other web offerings. Bastelgarage cannot know the content of these web offerings in detail, nor accept liability or any other responsibility for the content of these websites.


10. Privacy

Bastelgarage may process and use the data recorded in the course of the conclusion of the contract for the fulfillment of obligations from the purchase contract, as well as use it for internal marketing purposes. To constantly improve and optimize our offer, we use so-called tracking technologies.

The customer data is collected, processed, and used in accordance with the provisions of the Swiss Data Protection Act. The customer data is used only within Bastelgarage and is not disclosed to third parties.


11. Additional Provisions

Bastelgarage expressly reserves the right to amend these GTC at any time and to put them into effect without notice.

In the event of disputes, exclusively material Swiss law applies, excluding conflict-of-law norms. The UN Sales Law (CISG, Vienna Sales Convention) is explicitly excluded.

The legal venue is Bern, as far as the law does not provide for mandatory legal venues.
